1. Scope

This license applies only to source code, documentation, protocols, user
interface assets, and other materials originally created for XINGYUN and not
identified as third-party material (the "XINGYUN Materials"). Third-party
software, model weights, datasets, fonts, runtimes, and other components remain
under their respective licenses and notices.

2. Source code

The XINGYUN Materials are proprietary. No license is granted to copy, modify,
distribute, sublicense, sell, publish, host, or create derivative works from
their source form. Access provided to an authorized collaborator is limited to
the work expressly authorized by the rights holder and does not transfer
ownership or grant a public license.

3. Official beta binaries

Any person who lawfully obtains an official XINGYUN 0.1 Beta installer from
https://xingyun.cc/ is granted a limited, personal, non-exclusive,
non-transferable, revocable license to download, install, and execute the
unmodified object-code form on devices that person owns or controls, solely to
evaluate the beta and provide optional feedback to XINGYUN.

Except where applicable law requires otherwise, the recipient may not
redistribute, sublicense, sell, rent, provide as a hosted service, circumvent
technical restrictions, or reverse engineer the XINGYUN proprietary portions.
One archival backup copy is permitted for the recipient's own use.

4. Data and feedback

This license does not transfer ownership of user data. Feedback is optional.
No prompt, answer, document, credential, private file, or personal data is
licensed to XINGYUN merely because the software is installed or used. Any
separate contribution or training-data permission must be explicit.

5. Third-party materials

Notices and license texts supplied with third-party materials must be retained.
If a third-party license grants broader rights than this license, those broader
rights apply only to the corresponding third-party material. Nothing in this
license restricts rights granted directly by a third-party licensor.

6. Brand

No trademark, trade name, domain name, logo, or endorsement right is granted.
XINGYUN and 星云 may not be used to identify a modified or redistributed
product without prior written permission.

7. Beta status and disclaimer

THE SOFTWARE IS A PRE-RELEASE BETA AND IS PROVIDED "AS IS" AND "AS AVAILABLE,"
WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE
LAW. THE RIGHTS HOLDER DOES NOT WARRANT THAT IT IS ERROR-FREE, SECURE,
UNINTERRUPTED, OR FIT FOR A PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE RIGHTS HOLDER WILL NOT BE
LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES,
OR FOR LOSS OF DATA, PROFITS, BUSINESS, OR GOODWILL, ARISING FROM USE OF OR
INABILITY TO USE THE BETA.

8. Termination

This license terminates automatically upon material breach. On termination,
the recipient must stop using and delete the XINGYUN proprietary portions,
except where retention is required by law. Sections concerning ownership,
third-party rights, brand, disclaimers, liability, and governing legal limits
survive termination.

9. Mandatory rights

Nothing in this license excludes or limits rights or remedies that cannot
lawfully be excluded or limited. A separate written agreement signed by the
rights holder controls if it expressly conflicts with this license.
